This website and our services are provided by My E-Commerce FD Ltd, a company registered in England and Wales under company number 14804833(“we”, “us”, “our”). By using this site you agree to these terms. If you do not agree, please do not use the site.

The content on this website is provided for general information about our services only. Nothing on this website, and nothing said in an initial call or discussion, constitutes financial, investment, tax, accounting or legal advice, or a personal recommendation, and it should not be relied upon as such. You should always obtain tailored professional advice for your specific circumstances before acting.

We provide fractional finance director and related commercial finance support services. We are not your statutory auditor and do not provide regulated investment advice.

No guarantee of results

We bring experience, care and diligence to every engagement, but the performance and success of your business depends on many factors outside our control. Accordingly:

• We do not guarantee any particular result, outcome, saving, profit, growth, funding or other financial or commercial benefit. Any figures, examples or past results shared are illustrative and are not a promise or forecast of what your business will achieve.
• All decisions about your business remain yours. We provide analysis, reporting and recommendations; you are responsible for the decisions you take and their consequences.
• We are not responsible or liable for the success or failure of your business, including any loss, insolvency, downturn or failure to achieve expected performance.

Engagement and fees

Any engagement for services is subject to a separate written agreement or proposal setting out the scope, deliverables and fees. Nothing on this website constitutes an offer capable of acceptance or a binding contract. Fees are as agreed in that engagement and, unless stated otherwise, are exclusive of VAT.

Your responsibilities

The quality of our work depends on the information you give us. You agree to provide accurate, complete and timely information and access to the systems, records and people we reasonably need. We are not liable for any loss arising from inaccurate, incomplete or late information provided by you or on your behalf.

Confidentiality

Intellectual property

All content, branding, tools, templates and materials on this website and provided as part of our services are owned by or licensed to My E-Commerce FD Ltd and may not be copied, reproduced or reused without our written permission.

This website and our services may reference or link to third-party websites, providers and tools. We are not responsible for their content, availability, or for any products or services they provide, and any introduction we make is not a recommendation you are obliged to accept.

Referral and affiliate arrangements

Some links on this website are referral links. Where you sign up with a provider through one of them, or where we introduce you directly, that provider may pay us a referral fee or commission. This is paid by them, not by you, and it never increases the price you pay.

We introduce a provider because we think they are right for your business, we are happy to say when we have no arrangement with someone, and we will tell you if you ask about any specific introduction.

Nothing in these terms limits or excludes our liability for death or personal injury caused by our negligence, for fraud or fraudulent misrepresentation, or for any other liability that cannot be limited or excluded by law.

Subject to that:

• we provide this website “as is” and make no warranties about its accuracy, availability or fitness for a particular purpose;
• we will not be liable for any indirect, special or consequential loss, or for any loss of profit, revenue, savings, business, goodwill, data or anticipated benefit, whether arising in contract, tort (including negligence) or otherwise;
• our total aggregate liability arising out of or in connection with any engagement will not exceed the total fees paid by you to us for that engagement in the three months preceding the event giving rise to the claim, and, for the website alone, is excluded to the fullest extent permitted by law.

Detailed liability terms for any paid work are set out in the applicable engagement agreement, which takes precedence over this section for that work.

Termination

We may suspend or withdraw access to this website at any time. Termination of any services engagement is dealt with in the relevant engagement agreement.

Governing law and jurisdiction

These terms, and any dispute arising out of or in connection with them or our services, are governed by the laws of England and Wales, and are subject to the exclusive jurisdiction of the courts of England and Wales.

Changes to these terms

We may update these terms from time to time. The date at the top shows when they were last revised, and the current version applies to your use of the site.
